Understanding Back Taxes

Why is it a Pressing Concern?

When you owe back taxes, it means you have unpaid taxes from previous years. This situation can occur for various reasons, such as missed filing deadlines or underpayment of taxes due. The longer these taxes remain unpaid, the more complicated and burdensome the situation can become.

So, why is owing back taxes a pressing issue? Most essentially, the IRS imposes interest and penalties on unpaid taxes, which can quickly add up, increasing the amount you owe substantially over time. This financial strain can impact your overall financial health and stability.

Types of IRS Notices We Help With

There are dozens of IRS notices, but most taxpayers receive the most common notices, which include the following:

  • CP14: This is the first notice the IRS sends when a taxpayer has a past-due balance. It informs you of your balance and how you can pay.
  • CP501, 503, and 504: If you ignore CP14, the IRS will proceed with CP501, CP503, and CP504, all about six weeks apart. These notices gradually increase in urgency, reminding you that you have an unpaid balance and that the IRS will take more aggressive action if you do not respond.
  • Letter 1058/LT11: These letters are sent by certified mail. They give you 30 days to pay, set up payment arrangements, appeal, or face the loss of your assets–including joint bank accounts. These notices outline your right to request a Collection Due Process hearing.
  • Letter 1058-A: This is the same as Letter 1058, but it is sent to joint tax filers.
  • Notice of Federal Tax Lien: The IRS will notify you if they place a tax lien on your assets. This lien extends to all assets you currently own, as well as anything else you obtain while the lien is in place.
  • Notice of Jeopardy Levy: The IRS generally has to give taxpayers 30 days’ notice before levying their assets. If they believe collection is in jeopardy, they may use a jeopardy levy to seize assets without notice. They will then send a notice informing the taxpayer of the jeopardy levy.
  • ACS Notices: Most notices sent by the IRS are part of the Automated Collection System. These are sent on a pre-determined schedule if a taxpayer has not responded to the last notice.
  • Notice of Seizure: If the IRS does move forward with levying your assets, they will send you a notice telling you what they seized.

What Happens If You Ignore an IRS Collection Notice

People sometimes believe that ignoring IRS collection notices will make them go away—or at least delay the collection process until they can pay in full. However, the IRS collection process is usually automated. If you do not respond to initial notices, they will continue to move your case forward and take more aggressive action to collect what you owe.

Without any communication from you, they have to assume that you do not plan on paying or making other payment arrangements. At a minimum, ignoring IRS collection notices leads to accruing IRS interest and penalties. This alone can be a tough financial hit, since interest on unpaid tax debt compounds daily. The two most common penalties, failure-to-pay and failure-to-file, can each add up to 25% of your initial tax debt.

On top of interest and penalties, ignoring IRS collection actions can lead to more aggressive collection actions. The IRS can place a lien on your assets, garnish your wages, freeze your bank account, and seize other assets to collect what you owe. They can also revoke your passport if you owe over a certain threshold. There is no way to stop the collection process without taking action and setting up monthly payments or applying for a settlement.
